PrecastForge is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied. Albertastudio expressly disclaims all warranties, including:

• No Guarantee of Uninterrupted Operation: The ERP system may experience downtime due to Firebase App Hosting maintenance, Google Cloud infrastructure outages, or network disruptions.
• No Fitness for Regulatory Compliance: PrecastForge is a production management tool and does not guarantee compliance with CSA, ASTM, ACI, or provincial/federal building codes. All regulatory sign-offs remain the sole responsibility of the plant operator.
• No Absolute Data Retention: Developers do not guarantee immunity from Firestore outages, client-side cache loss, or Cloud Storage disruptions.
• No Accuracy of Financial Calculations: Financial modules, cost estimates, and material consumption reports are decision-support tools only and must be reviewed by a qualified accountant or plant manager before use in official financial reporting.

To the maximum extent permitted by the laws of Alberta and Canada, Albertastudio shall not be liable for any direct, indirect, incidental, consequential, punitive, or special damages arising from PrecastForge, including:

• Production Data Loss: Any loss or corruption of production records, batch histories, QA logs, material inventory records, or financial data stored in Firebase Firestore or Cloud Storage.
• Manufacturing Errors: Incorrect mix designs, dosage calculations, or scheduling decisions made based on information presented in the platform.
• Equipment Maintenance Failures: Any equipment damage, production stoppage, or safety incidents arising from reliance on maintenance schedules or alerts generated by the system.
• Financial Reporting Errors: Any accounting discrepancies, tax filing errors, or audit failures resulting from data generated by the Finances module.
• Third-Party Service Failures: Google Firebase, Vercel, or any other integrated infrastructure provider outages.
• Regulatory Non-Compliance: Any fines, penalties, or legal actions arising from the plant operator's failure to meet applicable manufacturing or environmental standards.

ALL SUBSCRIPTION FEES, SETUP FEES, ONBOARDING COSTS, AND LICENSING PAYMENTS MADE TO ALBERTASTUDIO FOR PRECASTFORGE ARE FINAL AND NON-REFUNDABLE.

• Monthly and annual subscription plans — no refunds for unused time
• Custom ERP configuration and onboarding fees — non-refundable once work commences
• No proration or credit for mid-period cancellations
• No retroactive refund following trial-to-paid conversion
• Multi-plant or enterprise license fees — non-refundable

Clients may cancel at any time via account settings. Cancellation is effective at the end of the current billing period.

IN ANY EVENT, THE TOTAL AGGREGATE LIABILITY OF ALBERTASTUDIO, ITS OFFICERS, EMPLOYEES, AND AGENTS, ARISING OUT OF OR RELATED TO PRECASTFORGE OR THESE TERMS, SHALL NOT EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY THE CLIENT TO ALBERTASTUDIO IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED CANADIAN DOLLARS ($100 CAD), WHICHEVER IS LOWER.

This limitation applies regardless of the legal theory — contract, tort, strict liability, or otherwise — and even if Albertastudio has been advised of the possibility of such damages.

BY USING PRECASTFORGE, YOU AGREE THAT ANY DISPUTES OR CLAIMS AGAINST ALBERTASTUDIO MUST BE RESOLVED ON AN INDIVIDUAL BASIS. YOU EXPRESSLY WAIVE ANY RIGHT TO BRING OR PARTICIPATE IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.

All disputes are governed exclusively by the laws of the Province of Alberta and the federal laws of Canada, and are subject to the exclusive jurisdiction of the courts of Alberta.

PrecastForge offers a 14-day trial environment with auto-generated demonstration data. The following applies to all trial accounts:

• All provisions of these Terms of Service apply in full to trial accounts, including all liability limitations and the No Refund Policy.
• Demo data is system-generated and does not represent real production records. Albertastudio bears no liability for any business decisions made based on demonstration data.
• Albertastudio may terminate trial accounts at any time without notice or compensation.
• Trial data may be permanently deleted 30 days after trial expiry if no subscription is activated.
• No refund is issued for subscriptions initiated and subsequently cancelled, regardless of trial status.

THE PLANT OPERATOR BEARS SOLE AND UNCONDITIONAL RESPONSIBILITY FOR REGULAR DATA BACKUPS.

Plant administrators must use the Reports and Export tools provided within PrecastForge to maintain external snapshots of critical production, inventory, and financial records. Albertastudio accepts zero financial or technical liability for loss of records that were not independently backed up by the plant operator.

Albertastudio is committed to protecting personal information in compliance with Alberta PIPA and federal PIPEDA.

• Data Controller: The plant organization is the Data Controller responsible for obtaining valid consent from its employees, contractors, and suppliers whose personal information is entered into PrecastForge.
• Data Processor: Albertastudio acts solely as a technical Data Processor. We do not sell, share, or monetize client production data, employee records, or financial information.
• Security: HTTPS/TLS 1.3 encryption for all communications; Firebase Firestore security rules; encrypted Cloud Storage; Firebase Authentication tokens.
• Retention: Upon subscription termination, all data is retained for 30 days then permanently deleted. Deletion requests: hello@albertastudio.dev
• OIPC Complaints: Office of the Information and Privacy Commissioner of Alberta — oipc.ab.ca

Albertastudio complies with Canada's Anti-Spam Legislation (CASL) when sending commercial electronic messages about PrecastForge.

• We send commercial email only with implied or express consent (for example, after you request a demo or contact us).
• Every commercial message identifies Albertastudio and includes a working unsubscribe method.
• You can withdraw consent at any time by using the unsubscribe link or emailing hello@albertastudio.dev.
• Transactional messages required to operate your account (login, billing, security) are not marketing and may still be sent.

These Terms shall be governed by the laws of the Province of Alberta and the federal laws of Canada. Exclusive jurisdiction: courts of the Province of Alberta.

By accessing or using PrecastForge, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and Privacy Policy in their entirety.
